Part V, Chapter 30 Procedures, Veterans Benefits Administration Manual M22-4, Education Procedures, is changed as follows.
Chapter 12 titled "Additional Contributions " is added. Substantive changes to existing instructions are as follows.
Paragraphs 12.04 clarifies who can make and receive the additional contributions. The policy advisory dated July 11, 2005 is rescinded.
Paragraph 12.07 includes information about the MGIB600 website, which has data about additional contributions. Paragraph 12.07 also clarifies how development should be done for additional contributions when development is necessary. The policy advisory dated February 16, 2006 is rescinded.
Paragraph 12.07b clarifies that a separate Leave and Earnings Statement (LES) is required to verify each additional contribution.
Paragraph 12.13 clarifies the effective date rules for the additional contribution benefit and provides the appropriate legal citations. This paragraph reverses the prior policy regarding payment of additional contributions after release from duty due to administrative error. If administrative error is confirmed by the service department, VA can now pay the additional contributions as though they were made while the person was still on active duty. The policy advisories dated October 4, 2007, December 22, 2003, and December 17, 2003 are rescinded.
Appendix B now includes a note regarding the payment of additional contributions in apprenticeship and on-the-job training cases.
Appendix C includes the statement that the MGIB600 website may be used to establish a claimant's RAD date as was indicated in a policy advisory issued June 28, 2007, which is not rescinded. System advisories dated July 27, 2006 and February 2, 2007 are rescinded.

Paragraph 1.05 tables are updated to reflect the two new eligibility categories and the change to the high school eligibility requirement brought about by Public Laws 106-419 and 107-103.
Paragraphs 1.09 and 1.10 are updated to reflect the new category IVC created by Public Law 106-419. The category IVB paragraph is updated to show that multiple periods may be considered.
Paragraph 1.15 is a new paragraph that provides details on the provision in Public Law 106-419 that category IA, IB, or IC eligibility can be based on any obligated period of active duty which first began after June 30, 1985. Previously, eligibility could only be based on an “initial” obligated period of active duty.
Paragraph 1.17a clarifies the types of service that are excluded from consideration in category IA, IB, 1C, Open Period and IVB cases.

This revision adds procedures for categories IVA and IVB and new cross references to the Code of Federal Regulations and other parts of the manual. Text repeated in other parts of the manual is deleted. Numerous changes are for clarity.
Paragraph 1.01 provides a chapter overview.
Paragraph 1.02 updates various definitions and deletes unnecessary definitions.
Paragraphs 1.03 through 1.15 are completely revised to restate in plainer language the eligibility requirements for the eleven chapter 30 eligibility categories. Each eligibility category now has its own separate table. The overview of the four broad eligibility categories is moved to paragraph 1.01. Material dealing with claims processing from the prior paragraph 1.04 is deleted as claims processing is outside the scope of this chapter.
Paragraph 1.17b consolidates the types of service that may not be counted in eligibility determinations.
Paragraph 1.17c(2)(c) is corrected to indicate that the term "continuous service" applies only to categories I and II.
Paragraph 1.17d deletes material on separation reason codes which properly belongs in chapter 3.
Paragraph 1.17e(1) clarifies situations where an honorable discharge certificate is not required.
Paragraph 1.17e(5) clarifies the statutory bars to benefits.
Paragraph 1.17f updates the paragraph on the education requirement. It includes the less common provisions.
Paragraph 1.17g makes it clear that the ROTC scholarship issue does not apply to eligibility categories III and IV, adds a new example, and moves the two existing examples for clarity.
Paragraph 1.18d clarifies the elections required when the individual has chapter 1606 eligibility.
Paragraph 1.19b(3) clarifies the rule for extending delimiting dates based on upgraded discharges. The rule applies to corrections of military records not just upgraded discharges.
Paragraph 1.20a(3) corrects the category IIA entitlement example.
Paragraph 1.20g(5) corrects the entitlement charge for flight training to state that the full-time rate includes supplemental benefits. (The service departments have never authorized supplemental benefits so this correction does not affect any current cases.)
Paragraph 1.20g(6) adds a cross reference for entitlement charges for tutorial training.
Paragraph 1.20h is added to cover entitlement calculations in open period cases.
Paragraph 1.23a reflects Public Law 105-261 which increased the limit on kickers to $950 effective October 1, 1998.

Paragraph 1.24c(1) is changed and a NOTE is added to clarify who may receive a lump sum payment. A lump sum will be paid to an eligible person (i.e., a veteran or a serviceperson) training at less than 1/2 time. A serviceperson training at 1/2 time or more will receive monthly payments in the same manner as a veteran.

Tables 1.01 through 1.04 are revised to show the chapter 30 rates, effective October 1, 1997. The revised tables show the correct chapter 30, category II rates for cooperative training, effective October 9, 1996. Public Law 104-275 reduced but did not eliminate the difference between the cooperative rate and the full-time institutional rate for category II. Public Law 105-114, enacted on November 25, 1997, eliminated the difference between the rates.
NOTE: In a letter, dated August 20, 1997, from Education Service to the four RPOs we incorrectly showed $125.43 as the monthly rate for the last six-month step of apprenticeship/OJT training (category IA). The correct rate is $125.08.

Paragraph 4.10 on cooperative training is rewritten. It explains how to pay the special rate for cooperative training before October 9, 1996. On and after October 9, 1996, the rate for cooperative training is the same as the rate for full-time institutional training.
Paragraph 4.11 is updated to show that the chapter 30 death benefit is available in certain category III and IV cases as well as in category I cases.
Paragraph 4.12c adds a procedure for removing erroneous dates of death from chapter 30 master records.
Paragraph 4.15 on manual entitlement calculations is updated. Adjudicators are reminded that the Chapter 30 PC system does not project the entitlement remaining at the end of an apprenticeship or other OJT program when an award is entered. The PC system computes entitlement remaining each time there is a payment. Sometimes manual entitlement calculations are needed for award letter purposes.
Paragraph 4.16 updates procedures for using the "M" override indicator on the 312 Award screen. Adjudicators should remove any unnecessary "M" override indicators whenever possible. The listing of all cases ever processed with M override indicators is discontinued and replaced with a listing of recent cases with M override indicators.
Paragraphs 4.18 and 4.19 are removed and the paragraph numbers are reserved for future usage. These paragraphs addressed category III issues which are covered in paragraphs 3.16 through 3.21.

Paragraph 3.18b clarifies the procedures for collecting $1,200 in category IIIC cases. Since there is no time limit for submission of $1,200, any case identified during normal case review that was previously denied because the claimant did not submit $1,200 should now be reconsidered.
Paragraphs 3.18 through 3.20 have been updated to reflect the regionalization of education benefits and the clarification of the time limit issue in category IIIC cases as described above.
